To the Honorable M.H. Peyton Judge of the Probate Court of
Copiah County Mississippi
The
petitionor of the under signed would respectfully represent unto your Honor
that he is an heir at law of Webster Gilbert and W.F. Gilbert both late
of said county now deceased and that the said decedent Webster Gilbert died
___red and possessed of the following real estate lying and being situated in
said County and described as follows, to wit: the South half of the South West
quarter and the South West Quarter and the South West Quarter of the South East
quarter of Section five and the North East quarter o Section eight the North
half of the North East quarter and the North half of the North West quarter and
the South East quarter of the North West quarter and the South West quarter of
the North East quarter of Section nine, all of Township eight Range six East
containing by estimation five hundred and twenty acres more or less, and the
said W. F. Gilbert dec’d seized and posssessed of the following real
estate to wit the South East quarter of the Noth East quarter of Section nine
Township eight Range six East. That Hannah Gilbert is the widow of said Webster
Gilbert deceased and has a dower interest in the lands above mentioned as
belonging to the said Webster Gilbert
deceased at the time of his death.
That this
petitioner has applied at the term of the Court to have the dower of the said Hannah allotted and
assigned to her according to the state___ in such case made and p___ed. That said decedents left being and ___ing e
the following ___ heirs to wit: your petitioner, Jane Davis wife of Woodard Davis, Nancy Ann Watson
wife of William A. Watson and W.D.
Gilbert who are equally interested in both the above mentioned tracts of
land after the ___ment of dower in the tract of land mentioned as belonging to
the said Webster Gilbert at the time
of his death. That the said W.F.
Gilbert was the brother of your petitioner and the above heirs above named
and the said Webster Gilbert was the father of them.
That your petitioner is desirous after the said allotment of
dower to have the balance of said land divided by metes and bounds among the
said heirs and to the ___ and therefore that the balance of said land may be divided
among the said heirs that all of the above named parties be ___ to be and
appear before this court at the next term to show cause if any the? Cause why
said land should not be divided and that upon the hearing of this petition your
honor will grant an order to have said lands divided according to law among
said heirs and your petitionor ___ in duty bound will ___ pray.
