Estate of W. & W.F. Gilbert

Report  Division of Real Estate

Filed 15th July 1867

 

To the Honorable Probate Court of Copiah County

State of Mississippi

The undersigned Commissioners appointed by said Court at the last June Term thereof and directed among other things to divide the real estate of Webster Gilbert and W. F. Gilbert deceased among their heirs at law agreeably to the law of descents of this State and to ascertain by mets and bounds each heirs share of said real estate and to allot to them their respective shares thereof: respectfully report that pursuing the instructions contained in the commission to them directed and the rule of the Statute in their behalf after giving five days notice to the heirs, they assembled for the purpose of making said divis.  At the late residence of said decedent Webster Gilbert on the 17th day of June AD 1867 and ______ lands directed to be divided exclusive of the dower of the widow Hannah Gilbert therein and described as follows to wit:

The S ½ SW ¼ & SW ¼ of Section (5) five and the N ½ N ½ & SE ¼ NW ¼ & SE ¼ NE ¼ of Section (9) nine & NE ¼ Sect. 8 all in Township (8) eight Range (6) six East and caused the same to be divided into four equal parts, having due regard to quantity and quality defining and marking and marking each of said parts by metes and bounds which said Survey and division will fully appcar by reference to the surveyed plot and certificate of Surveyor employed marked “A” upon which your Commissioners have ____ said parts of said division to be marked and numbered respectively one, two, three and four and that your commissioners then by lot assigned and set off to said heirs their respective shares of said lands as follows to wit:

 

Lot No. One was allotted and set off to Luanza J. Davis

Lot No. Two was allotted and set off to Nancy A. Watson

Lot No. Three was allotted and set off to R.B. Gilbert

Lot No. Four was allotted and set off to D.W. Gilbert

And your commissioners further report that they valued said lots respectively as follows to wit: Lot No. one at $585.00) five hundred and eighty five dollars.  Lot No. two at ($320.00) three hundred and twenty dollars.  Lot No. three at ($240.00) two hundred and forty dollars.  Lot No. four at ($240) two hundred and forty dollars, and that to equalise said lots and to compensate the said Nancy A. Watson, R.B. Gilbert and D.W. Gilbert, __ the deficit in the share respectively allotted to them they did and they do hereby award that the said Luanza J. Davis pay to the said Nancy A. Watson $26.25/100 dollars and that the said Luanza J. Davis pay to the said R.B. Gilbert $106 25/100 dollars and that the said Luzanz J. Davis pay to the said D.W. Gilbert $106 25/100 dollars thereby setting the value of each of said four shares at $346 25/100 dollars, and your commissioners having now fully discharged the duties enjoined upon them by said commission and having now fully reported their proceedings under and by authority thereof beg leave to be discharged.

Given under our hands and seals this the 19th day of June AD 1867.

Copiah County             }                      Personally appeared before the undersigned Justice of the Peace in and for said County the foregoing named Joseph E. Chiles, Robert Hamilton and Seth Applewhite who after being duly sworn deposed and said that the foregoing report contained an honest faithful and impartial division of the real estate of
Webster Gilbert and W.F. Gilbert exclusive of the dower of said Hannah Gilbert the widow of said Webster Gilbert deceased and they have performed the duties and services required of them in this behalf to the best of their skill knowledge and judgement.

Abstract of above

In July 1867, commissioners reported on the division of the real estate of Webster Gilbert and W.F. Gilbert. The commissioners then by lot assigned and set off to the heirs their respective shares of the lands as follows:

 

Lot No. One was alloted and set off to Luanza J. Davis

Lot No. Two was alloted and set off to Nancy A. Watson

Lot No. Three was alloted and set off to R.B. Gilbert

Lot No. Four was allotted and set off to D.W. Gilbert
