William Gilbert by Admr Webster Gilbert to William Martin

This the indenter (sic) made this sixth day of December in
the year eighteen hundred and thirty seven between Webster Gilbert Administrator
of all and singular the goods and chattles rights credits which were of William
Gilbert late of the County of Copiah in the State of Mississippi deceased
of one part and William Martin of the other part witnesseth that whereas
by an order of the probate court of said county of Copiah the said party of the
first part was ordered to sell on a credit of twelve months to the highest
bidder the following real estate of the said William Gilbert deceased to wit: The South half of the west half of
the north east one fourth of Section Number Eight Township number eight North
of Range number Six east, containing forty acres of land more or less. Also the South half of the west half of
South east one fourth one fourth of Section number five township eight number
eight north of Range number six east containing thirty eight acres and ninety
four hundredths of an acre of land. All
being in the County of Copiah and State aforesaid and whereas in pursuance of
said order of Court and due and legal notice of the same time and place of sale
of said lands being given the same was put at public auction on the first day
of this instant to the highest bidder and the said party of the second part
being the last and highest bidder for said land and becoming purchaser hereof
at the sum of four hundred and fifty Dollars and the said party of the second
part having given bond and security for the payment of the purchase money in
one year from the date of said sale therefore in consideration of the premises
the said party of the first part hath granted bargained and sold and by these
presents doth hereby grant bargain sell and convey unto the said party of the
second part the above described Real Estate with all the privledges and
appurtenances thereto belonging to have and to hold the said tracts of land with
all the priveledges thereto belonging unto the said party of the second part
his heirs and assigns forever and the said party of the first part as such
Administrator as aforesaid doth hereby covenant and agree to and with the said
party of the second part the said tracts of land with all the privaledges and
appurtenances thereto belonging unto the said party of the second part his
heirs and assigns forever so far as the __ forth as he the said party of the
first part is bound so to do by virtue of said of administrator as aforesaid in
testimony whereof the said party of the first part have hereunto set his hand
and seal the day and year above written. His
