In the matter of the petition of R.B. Gilbert for division
of the real estate of Webster Gilbert deceased.
On
reading
And filing the petition it appearing to te satisfaction of
the Court that the said R.B. Gilbert is one of the heirs at law of said Webster
Gilbert & W.F. Gilbert deceased and that he is now of lawful age to
claim a division of said real estate and it also appearing to the satisfaction
of the Court that D.W. Gilbert, N.A.
Watson and her husband William A. Watson, Louansa Jane Davis and her husband
W.W. Davis and Hannah Gilbert, heirs and distributees of said decedent have
waived notice in writing of the pending of said petition and consented That the
Court might act in the pl____. It is
therefore ordered by the Court that Joseph O. Chiles, Robert Hamilton, Seth
Applewhite, Eldridge Applewhite and Davis Applewhite disintersted freeholders
of this County be appointed commissioners and as such they hereby ordered and
directed to divide the said real estate mentioned in said petition excepting
the dower of the said Hannah Gilbert. Order agreably to the law of descents And
to allot and set apart each heirs share thereof and that they make and return
under oath a full report of their proceeding under their order at a subsequent
time of this Court.
Ordered, adjudged and decreed this the 3rd day of
June A.D. 1867.

Know ye,
that at a term of the Probate Court of Copiah County, State aforesaid, begun
and held at the Court House in and for said County on the first Monday in June
A.D. 1867, you were appointed commissioners to divide the real estate of
Webster and W.F. Gilbert, late of said County, deceased, among their legal
heirs: And you are by these presents
authorized and directed to divide the said real estate among the heirs at law
of the said decedents agreeably to the law of descents of this State: to
ascertain each heir’s share thereof by mets and bounds, and to assign and set
off the said heirs respectively their shares of said real estate so ascertained
and allotted. And you are by these
presents further directed to give five days notice of the time and place of
your meeting for the purpose of making said division to such of said heirs as
are of age and within this State, and to the guardians of such as are minors,
and to make and return under oath a full report of your proceedings under this
commission, certified under your hands and seals at some subsequent term of this
court.
Witness the
Honorable M. H. Peyton Judge of the Probate Court of said County at the Court
house, thereof, the first Monday in June A.D. 1867.

In the matter of the final settlement of the Est of Webster
Gilbert dec’d
The acct
final of Hannah Gilbert admix of said Est coming on for acrediting and
allowance at the present Term of the court, and it appearing to the
satisfaction of the court that all parties interested have had legal notice of
the filing and presenation of said account, and the court having examined the
same as to its charges and discharges, and finding the same to be in all thinhs
correct as therein stated. It is
therefore ordered adjudged and decreed that said account be allowed as stated
and that he said Hannah Gilbert be allowed the sum of $67.56 allowance due her
as administratrix as aforesaid on said ___ ___ ___ ___ discharged as
administratrix of said Estate.

adjudged and decreed this 4th day of January 1864?
I hereby waive notice of citation authorise in the matter of
the final settlement of H. Gilbert Exrx of W. Gilbert dec’d now on file in the
Probate Court of Copiah County & consent That the said may be allowed as
stated

Surveyed by me with L. Gaskin and J. M. Magee two of the Commissioners as Chain
bearors.
