Will of J A Gilespie, Thyatira, Miss Mch 20th/94

I J A Gillespie being of sound mind but knowing the uncertainty of life do make ordain and declare this to be my last will and testament viz.

Item 1st I give my body to the ground and my spirit to God who gave it and as to such earthly possession and the Lord has blessed me with, I depose of in the following manner.

Item 2nd It is my will that all of my just debts shall be paid as soon after my death as practicable. 

Item 3rd I give and bequeath to my beloved wife Malinda all of my property real and personal to manage and contract as she may think best, But to give to each of my children as they become of age or marry 80 acres of land and a horse.

Item 4th It is my wish that my estate be kept ??? out of the Courts.

Item 5th It is also my will that my grand children shall together receive a Childs share.

The State of Mississippi, Tate County, Chancery Court
Before the clerk in vacation Aug 10, 1894

In the matter of a certain instrument of writing purporting to be the last will and Testament of J A Gillespie deceased.

This day came before the undersigned Clerk of our said Court R W Locke one of the subscribing witnesses to a certain instrument of writing bearing date the 20th day of March 1894 and purporting to be the last will and testament of J A Gillespie late of Tate County, deceased who after being first duly sworn according to law deposes and say that he saw the said J A Gillespie sign publish and declare the said instrument of writing on the day of its date as and for his last will and testament.

That he this deponent signed the same as subscribing witness thereto in the presence of the said J A Gillespie, and at his request that the said J Y Wright and Gillis Campbell the other subscribing witnesses signed said instrument in the presence of said J A Gillespie. That he and the other subscribing witnesses subscribed the same in the presence of each other. And that at the time of the signing said writing the said J A Gillespie was of sound and disposing mend and more than twenty one years of age.
