Last Will And Testament Of
Thomas D Kizer

I, T. D. Kizer, of Belzoni, Mississippi, being of sound and disposing mind and memory, do make and publish this my last will and testament, and do hereby revoke any former wills or purporting to have been made by me.

Item I   

I will that all my just debts and funeral expenses including a monument to cost ($50) fifty dollars be paid by my executor herein after named.

Item 2

To my son Cecil Kizer and his heirs I will and bequeath the south west quarter of the south east quarter of Section (30)  Township (5) Range (9) county of Tate State of Mississippi and also such of my personal effects, money and rents necessary for carrying out the provisions of this will.

It is my intention in this will to give to said Cecil Kizer and his heirs the use, benefits and income from the land bequeathed to him, but it is not my intention to give to said Cecil Kizer or his heirs the right to dispose of or sell said land.

Item 3

I give and bequeath to Rupert Clark Morris, Jr., my grandson, the north west quarter of the south east quarter of said section (30) Township (5) Range (9) County of Tate, State of Mississippi.

Item 4

I appoint my son, Cecil Kizer executor of this will and specially relieve him from giving any bond, filing and appraisement or making any settlement with any court.

IN TESTIMONY WHEREOF I have hereunto set my hand this 19th day of August, A.D. 1912.

The said T.. D. Kizer signed the 19th day of August, 1912.

Proof

STATE OF MISSISSIPPI}    In the matter of a certain instrument of writing purporting to be the last will and testament of T. D. Kizer, deceased.
COUNTY OF TATE        }

Be it remembered, That on this day personally appeared before me, E. C. Moreland, a notary public for the 5th district of the state and county last aforesaid, W. S. Knotts, one of the subscribing witnesses to a certain instrument of writing, purporting to be the last will and testament of T. D. Kizer, last of Tate County signed, published and declared said instrument as his last will and testament on the 19th day of August, 1912, the day of the date of said instrument in the presence of this deponent, and in the presence of C. N. Chilton, the other subscribing witness to said instrument that said testator was then of sound and deposing mind and memory, and more than twenty one years of age; and that he, said deponent, and the said C. N. Chilton, subscribed and attested said instrument as witnesses to the signature and publication thereof, at the special instance and request, and in the presence of said testator and in the presence of each other, on the day and year of the date thereof.
